1. Acceptance of Terms

By downloading, installing, or using Progress Pics - Body Tracker ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

Progress Pics - Body Tracker is a mobile application that allows users to track their body transformation journey through photos, measurements, and other fitness-related data. The App offers both free and premium subscription features.

3. Subscriptions and Payments

3.1 Auto-Renewable Subscriptions

Progress Pics - Body Tracker offers auto-renewable subscription options to access premium features. By purchasing a subscription, you agree to the following:

• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscription Period: Subscriptions are available on a weekly or annual basis.
• Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as your original subscription.

3.2 Free Trials

We may offer free trial periods for premium subscriptions. If you start a free trial:

• You will not be charged during the free trial period.
• At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

3.3 Managing Subscriptions

You can manage or cancel your subscription at any time through your device's account settings:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play Store > Menu > Subscriptions

Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid subscription period.

3.4 Refunds

All purchases are processed through Apple App Store or Google Play Store. Refund requests must be made directly through the respective store according to their refund policies.

4. User Conduct

You agree to use the App only for lawful purposes. You must not:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the integrity or performance of the App
• Upload or transmit viruses or any other malicious code
• Use the App to store or transmit content that is illegal, harmful, or violates the rights of others

5. User Content

You retain ownership of all photos, measurements, and other content you create or upload to the App ("User Content"). By using the App, you grant us a limited license to store and process your User Content solely for the purpose of providing the App's services to you.

You are solely responsible for your User Content and the consequences of uploading or publishing it. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

6. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.

7. Intellectual Property

The App, including its original content, features, and functionality, is owned by Progress Pics and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

The App is not intended to provide medical advice. Always consult with a qualified healthcare professional before making any health-related decisions.

9. Limitation of Liability

To the maximum extent permitted by law, Progress Pics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

10. Indemnification

You agree to indemnify, defend, and hold harmless Progress Pics and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of these Terms. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
